Terms of Service

This is the agreement between you and EvePhase. It sets out what the app is designed to do, what it does not replace, and the small number of rules that keep the service usable for everyone.

Medical disclaimer. EvePhase is a wellness and personal-tracking tool. It is not a medical device, does not diagnose, treat, or prevent any condition, and does not replace professional medical advice. If your symptoms are new, severe, or worrying — including anything that might be a heart attack, stroke, blood clot, or severe bleeding — contact your GP or emergency services immediately.

1. Your agreement with us

By creating an account or continuing to use EvePhase, you agree to these Terms. If you disagree with anything here, please do not use the service.

Along with these Terms, our Privacy Policy explains how we handle your data. Together they form the complete agreement between us.

2. Who can use EvePhase

You must be at least 18 years old and legally capable of entering into a binding agreement in your country of residence. EvePhase is designed for adults navigating perimenopause and menopause, or supporting someone who is.

EvePhase offers a free tier and an optional paid Premium tier. Premium is billed through Apple's App Store or Google Play, according to their respective terms.

8. Partner mode

If you invite a Partner, you decide what data categories they can see. You can change or revoke access at any time. If you are a Partner, you agree only to use the data shared with you to support the person who invited you — not for any other purpose.

Both parties agree to respect each other's autonomy and privacy. Withdrawing an invitation is your right; accepting one is voluntary.

9. Intellectual property

EvePhase, its name, logo, source code, designs, and content (excluding your content) are our property or licensed to us. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the app for its intended purpose. No other rights are transferred.

10. Your content

Your logs, notes, and generated reports remain your data. By using the service, you grant us the limited licence necessary to store, process, and display your data back to you (and to any Partner you have authorised).

We do not use your data to train third-party AI models. We do not sell it. Full detail is in our Privacy Policy.

11. Suspension & termination

You may end this agreement at any time by deleting your account from the settings screen or emailing us.

We may suspend or terminate your account, with reasonable notice, if you materially breach these Terms — for example by using the service to harm another user, attempting to break the service, or engaging in fraud. Where possible we will notify you first and give you a chance to fix the issue.

12. Warranty disclaimer

The service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties — express, implied, or statutory — including any warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Nothing in these Terms limits any right you have under mandatory consumer law.

13. Limitation of liability

To the maximum extent permitted by applicable law, EvePhase, its owners, employees, and suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or in connection with your use of the service.

Our total aggregate liability for any claim arising out of these Terms will not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) fifty US dollars. Some jurisdictions do not allow these limitations; where that is the case, they apply to the maximum extent permitted.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by applicable law, including liability for death or personal injury caused by negligence, or for fraud.

14. Governing law

These Terms are governed by the laws of the jurisdiction in which the operator of EvePhase is established, without regard to conflict-of-laws principles. Where you are a consumer in the UK or EU, you retain the benefit of any mandatory consumer-protection laws of your country of habitual residence.

Disputes we can't resolve amicably will be handled in the courts of that jurisdiction, subject to your mandatory consumer rights.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified in-app and by email at least 14 days before they take effect. Continued use of the service after that date constitutes acceptance of the new Terms. If you don't agree, you may stop using the app and delete your account.
